Truth revealed over littering from vehicles regulations

In July 2016 DEFRA wrote to Highways England saying that they were planning to give bodies that had a responsibility to keep land free of litter the power to issue the new Penalty Charge Notices for littering from vehicles. They asked HE if they wanted to take these powers on. HE said they did not.

In their April 2017 consultation document on the Littering from Vehicles Regulations DEFRA stated that:

To maintain parity, rather than give new enforcement functions to Highways England in isolation, we propose that district councils should remain responsible for all littering enforcement (criminal or civil) on the Strategic Road Network.

Then on 17th November 2017 HE wrote to DEFRA saying “I do hope it’s not too late to allow Highways England the powers to issue PCNs

DEFRA however chose not change the draft Regulations and they were approved by Parliament on 1st February 2018. After all they could hardly admit that their “maintaining parity” argument was to cover up the fact that HE did not want to take on the powers.

As a consequence the Regulations do not apply to the motorways and some HE trunk roads.
