Dear Mr Price,

I am writing to you in your capacity of Chief Executive of the Office of Rail Regulation about trackside litter.

Mr David had complained about of trackside litter at Marlas Road, Bridgend and had attached photographs one of which is reproduced above. I am myself well aware of similar long term litter accumulations along the Chiltern Line between West Ruislip and Marylebone.

Seemingly Network Rail are operating in ignorance of their duty under S89 (1) (e) of the Environmental Protection Act 1990 in respect to their relevant land to ensure that it is, so far as is practicable, kept clear of litter and refuse.

Litter should be cleaned promptly regardless of whether or not it constitutes a safety risk. They should acknowledge their S89(1) duty and say how they interpret the practicability provision.

Could the ORR please investigate Network Rail’s failure in this regard.
