These are my notes from a conversation with a clerk of the court regarding the procedures for a contested hearing
The complainant would be asked to make a brief statement explaining what has happened, and what they are demanding e.g. a litter abatement order and costs or, if the litter has been removed, just their costs.
The complainant would then enter witness box and make a more detailed statement and be cross examined by the defendant.
The complainant would then call any witnesses and take them through their evidence. This has to be done without making leading statements. Rather than say did you see litter etc ask what they saw.
They will then be cross examined by the defendant
The defendant will call his witnesses who can be cross examined by the complainant.
Both sides them make their closing statements
