Brighton council in breach of law over refuse bags

Brighton & Hove City Council are breaking S33 of the Environmental Protection Act by allowing residents to place their refuse bags on the pavement.
I am indebted to Craig Macpherson for drawing my attention to the page on the council’s web site that tells residents what to do with their bags of domestic waste. The relevant sections are reproduced below
