DEFRA’s Litter and Refuse Guidance on Part 4 of the Environmental Protection Act 1990 as amended by the Clean Neighbourhoods and Environment Act 2005

States that:
“3.2 Persons with a complaint about litter should always bring the matter to the attention of the duty body first, before taking action under section 91.(Local authorities and other duty bodies should inform the public about procedures for making a formal complaint, and the right to seek redress in the courts, if the litter duty is not met.)”
I can see nothing on The Highways Agency website about seeking redress via the courts under EPA S91.
Could you please confirm this omission will be corrected
Also, I can see no specific reference to litter on your “contact us” page. I recommend you amend
“For all queries, complaints, feedback and fault reporting regarding the Highways Agency’s network:”
To:
“For all queries, complaints, including complaints about litter, feedback and fault reporting regarding the Highways Agency’s network:”
