Please refer to Highways England litter Judicial Review – process initiated. I received a reply on 14th February to my warning letter to Grant Shapps MP of 10 February. I replied on 17th February

The DfT have not completed the actions I requested by 14th February firstly to answer the question “how can I now, or could I have had in the past, made representations to the Minister or your department re the need for a kpi for litter and what it should say, if no draft RIS (inclusive of kpis) has ever been available and you cannot even tell me if there is one in the version awaiting final approval?”

Secondly to provide me with draft KPIs and objectives for litter as they appear in the most up to date draft / version of RIS 2.

They now have until 28th February to provide me with the final text of an RIS2 objective and a KPI for litter which would be consistent with HE’s duty under EPA S89(1) and enable the ORR to independently monitor compliance with them through random checks without relying on data provided by HE or their contractors.

Failing that I will go to the High Court and ask them to instruct the DfT to modify RIS 2 accordingly.
