Please refer to DEFRA in breach of EPA over Litter Code’s response times

In an e-mail to the Permanent Secretary at DEFRA I had argued that the Code’s response times offered duty bodies a debased standard of compliance with their Environmental Protection Act Section 89(1) duty. This puts them in breach of their EPA S89(7) duty to provide practical guidance on the discharge of the S89 duty.

In reply DEFRA failed to defend the wording of the Code saying: “Any upcoming changes to the Code will be subject to a consultation process, where your input will be greatly appreciated”.
