This draft is based on DEFRA’s Litter Abatement Notice – Model Form ENVIRONMENTAL PROTECTION ACT 1990 SECTION 92(1) but heavily modified to take account of the differences between S91 (action by a citizen) and s92 (action by a Principal Litter Authority – usually a local authority. My complaint for a litter abatement order was presented under oath to District Judge Wright at Uxbridge Magisrtates Court. She agreed to sign a summons requiring London Underground to attend a hearing on 29th August at 10.00 am. This post contains the full package of information presented. If you decide to apply to the court for a Litter Abatement Notice the duty body may argue that you have not given them enough time to clear the litter away. I therefore suggest that you wait more than the minimum 5 day notice period following the EPA Section 91 Warning Notice before making a formal complaint for a Litter Abatement Order.
