Dear Mr Nugent,

Thank you for your e-mail of 18th February. I am sorry to trouble you but could you please clarify some points for me.

  1. When did you receive a copy of my warning notice?
  2. Since I made my complaint has anyone from the Highways Agency inspected the area complained about and, if so, when and what did they report back?
  3. Since I made my complaint has anyone from your contractors inspected the area complained about and, if so, when and  what did they report back?
  4. On what day did the inspection of the week commencing 18th January take place?
  5. Did the inspector report on the cleanliness of the whole of the verge, i.e. from the hard shoulder to the boundary fence, or only from the hard shoulder up to the low rabbit fence a foot or so from the hard shoulder?
  6. As there is a hard shoulder between the slip road and the area complained about is traffic management, i.e. closure of the whole slip road an essential requirement to clean the area complained about  or would it be sufficient to employ a blocking vehicle on the hard shoulder?
  7. When the slip road was cleaned on 5th September was the whole area complained about cleaned or was the cleaning only up to the rabbit fence?

Please note it is still my intention to apply to the Magistrates Court for a Litter Abatement Order if this obviously long standing refuse is not removed after the 28 day notice given in my warning notice i.e. by 25th February

Mr Nugent, can I suggest we meet at the location on Monday so that I can show you the situation first hand.  We could also take the opportunity of looking at other M40 slip roads which are in a dire condition.

Mr Nugent, I have re-read your e-mail of 18th Feb and I have some further questions.

1. You say “M40 J8a southbound entry slip road was last cleared of litter on 05 September 2010”.  But  urine bottles could be thought of as “refuse” rather than “litter”.  Were the presence of  urine bottles identified on this occasion and if so were they removed?

2. Can you please let me have a copy of the paperwork produced by the operatives who carried out the clearing work on the 5th Sept 2010 recording what they had done.

3. You say you are closing the slip from 14th – 18th . Will it be closed during the day or just at night?

4. Why do both lanes have to be closed at the same time.

5. Why couldn’t most, if not all, of the verge have been cleaned within days of my complaint without closing the slip road?  The operatives could have been protected by  positioning blocking vehicles on the hard shoulder. Only at the entry point from the roundabout onto the slip road is there no hard shoulder. Please refer to
